Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you" or "Client") and Forbidden Ridge Outfitters ("Forbidden Ridge Outfitters," "we," "us," or "our"), concerning your access to and use of the https://forbiddenridgeoutfitters.com/ website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site") and the services we offer (the "Services").

You agree that by accessing the Site and/or booking our Services, you have read, understood, and agree to be bound by all of these Terms. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND OUR SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time and for any reason. We will alert you about any changes by updating the "Effective Date" of these Terms, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms by your continued use of the Site or our Services after the date such revised Terms are posted.

2. Our Services

Forbidden Ridge Outfitters provides guided hunting trips, adventure trips, drop camps, and related outfitting services in the State of Montana, primarily within permitted areas of the Beaverhead-Deerlodge National Forest and the Helena-Lewis and Clark National Forest, as detailed on our Site and in specific trip agreements ("Service Agreement" or "Booking Confirmation"). Services may include, but are not limited to, guide services, provision of camp accommodations and meals (as specified per trip), pack services, and transportation within the designated hunting/trip area. Specific inclusions and exclusions for each trip will be outlined in the Service Agreement.

3. Bookings, Deposits, and Payments

3a. Booking Procedure: To book a trip, you must contact Forbidden Ridge Outfitters and complete any required booking forms. All bookings are subject to availability and confirmation by us.

3b. Deposits: A non-refundable deposit of [Specify Percentage, e.g., 50%] of the total trip price is required to secure your booking unless otherwise stated in your Service Agreement. Your booking is not confirmed until the deposit is received.

3c. Final Payment: The remaining balance of the trip price is due no later than [Specify Number, e.g., 60] days prior to the trip start date, unless otherwise specified. Failure to make the final payment by the due date may result in cancellation of your booking and forfeiture of your deposit.

3d. Payment Methods: We accept payment by [List Accepted Payment Methods, e.g., check, credit card (Visa, MasterCard, Amex), bank transfer].

3e. Pricing: All prices are quoted in US Dollars and are subject to change without notice until a booking is confirmed with a deposit. Prices typically do not include hunting licenses, tags, government fees, taxes, guide gratuities, personal gear, taxidermy, meat processing, or travel to/from the designated meeting point in Montana, unless explicitly stated otherwise in your Service Agreement.

4. Cancellations and Refunds

4a. Cancellation by Client: If you need to cancel your trip, you must notify Forbidden Ridge Outfitters in writing. Cancellation fees will be applied. We strongly recommend you purchase trip cancellation insurance.

4b. Cancellation by Forbidden Ridge Outfitters: We reserve the right to cancel any trip prior to departure for reasons including, but not limited to, insufficient bookings (for group trips), guide illness or injury, extreme weather conditions, government actions, or other unforeseen circumstances that make the operation of the trip unsafe or unfeasible. If we cancel your trip, we will offer you the option of a full refund of payments made directly to us for the trip, or we may offer to reschedule your trip for a future date, subject to availability. Forbidden Ridge Outfitters is not responsible for any incidental expenses or consequential losses that you may have incurred as a result of your booking, such as visas, vaccinations, non-refundable flights or other travel, etc.

4c. No-Shows: No refunds will be given for no-shows or for unused portions of a trip.

5. Client Responsibilities

5a. Licenses and Permits: Clients are responsible for obtaining and possessing all necessary hunting licenses, tags, stamps, and permits as required by Montana Fish, Wildlife & Parks and any other applicable federal or state regulations. We may provide guidance, but the ultimate responsibility lies with the client.

5b. Compliance with Laws: Clients must comply with all Montana and federal fish and game laws and regulations, as well as any safety rules and instructions provided by our guides and staff.

5c. Physical Condition and Disclosure: Clients must be in suitable physical condition for the demands of the booked trip. You are responsible for disclosing any medical conditions, physical limitations, or dietary restrictions to us at the time of booking. We reserve the right to decline service to any person we judge incapable of meeting the rigors and requirements of participating in the activities.

5d. Personal Gear: Clients are responsible for bringing appropriate personal clothing, footwear, medication, and equipment as recommended on our gear lists.

5e. Conduct: Clients are expected to conduct themselves in a respectful manner towards guides, staff, other clients, wildlife, and the environment. We reserve the right to terminate the trip of any client who acts in a manner that is dangerous, disruptive, or contrary to applicable laws or our policies, without any refund.

5f. Hunter Education: All hunters born after January 1, 1985, must have completed a certified hunter education course and carry their certification card. [Verify current MT FWP requirements].

6. Assumption of Risk and Release of Liability

6a. Acknowledgment of Risks: You acknowledge that participation in guided hunting, horseback riding, hiking, camping, and other outdoor adventure activities offered by Forbidden Ridge Outfitters involves inherent and unavoidable risks, dangers, and hazards. These risks may include, but are not limited to: accidents or illness in remote places without medical facilities; encounters with wild animals (including bears, wolves, mountain lions, moose, snakes, insects); firearms use and safety; horseback riding risks (falling, being kicked, bit, or stepped on); variable and extreme weather conditions (cold, heat, snow, rain, wind, lightning); rough or unpredictable terrain (cliffs, deadfall, rivers, uneven ground); use of equipment; potential for property loss or damage; and other risks associated with wilderness travel and outdoor activities.

6b. Voluntary Assumption of Risk: Your participation in our Services is purely voluntary, and you freely accept and fully assume all such risks, dangers, and hazards and the possibility of personal injury, death, property damage, or loss resulting therefrom.

6c. Release and Waiver of Claims: In consideration of being permitted to participate in our Services, you hereby agree, for yourself, your heirs, executors, administrators, and assigns, to release, waive, discharge, and covenant not to sue Forbidden Ridge Outfitters, its owners, officers, employees, guides, agents, contractors, and assigns (collectively, the "Releasees") from any and all liability, claims, demands, actions, and causes of action whatsoever, arising out of or related to any loss, damage, or injury, including death, that may be sustained by you, or to any property belonging to you, whether caused by the negligence of the Releasees or otherwise, while participating in such activity, or while in, on or upon the premises where the activity is being conducted. [NOTE: The extent to which liability for negligence can be waived varies by jurisdiction. This clause NEEDS legal review in Montana.]

7. Intellectual Property Rights

Unless otherwise indicated, the Site and all its content (including source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics – collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States, foreign jurisdictions, and international conventions. The Content and the Marks are provided on the Site "AS IS" for your information and personal use only. Except as expressly provided in these Terms, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

8. User Representations (If applicable, e.g., for account creation or comments)

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL FORBIDDEN RIDGE OUTFITTERS OR OUR DIRECTORS, EMPLOYEES, GUIDES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE OR OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US FOR THE SERVICES DURING THE [Specify Period, e.g., SIX (6) MONTH] PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING. 12. Indemnification

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) your use of the Services; (2) your breach of these Terms; (3) any breach of your representations and warranties set forth in these Terms; (4) your violation of the rights of a third party, including but not limited to intellectual property rights; or (5) any overt harmful act toward any other user of the Site or Services with whom you connected via the Site or Services. Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.

13. Governing Law and Dispute Resolution

These Terms and your use of the Site and Services are governed by and construed in accordance with the laws of the State of Montana applicable to agreements made and to be entirely performed within the State of Montana, without regard to its conflict of law principles. Any legal action of whatever nature brought by either you or us shall be commenced or prosecuted in the state and federal courts located in [Specify County, e.g., Lewis and Clark County (if Helena is base) or Beaverhead/Deer Lodge County], Montana, and the Parties hereby consent to, and waive all defenses of lack of personal jurisdiction and forum non conveniens with respect to venue and jurisdiction in such state and federal courts. WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SITE AND THE SERVICES (INCLUDING BLOCKING CERTAIN IP ADDRESSES), TO ANY PERSON FOR ANY REASON OR FOR NO REASON, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY, OR COVENANT CONTAINED IN THESE TERMS OR OF ANY APPLICABLE LAW OR REGULATION. WE MAY TERMINATE YOUR USE OR PARTICIPATION IN THE SITE AND THE SERVICES OR DELETE [YOUR ACCOUNT AND - if applicable] ANY CONTENT OR INFORMATION THAT YOU POSTED AT ANY TIME, WITHOUT WARNING, IN OUR SOLE DISCRETION.

15. Modifications to Terms and Services

We reserve the right to change, modify, or remove the contents of the Site or these Terms at any time or for any reason at our sole discretion without notice. We also reserve the right to modify or discontinue all or part of the Services without notice at any time. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Site or the Services.

I had the pleasure of meeting Erik at the 2024 Elk camp out of Deer Lodge. Erik was part of Mike

Smith's crew with Bartlett Creek Outfitters. I got to know Erik during my 5 days in camp and even

though I didn't punch my tag I had a chance but that's another story. Erik is a middle east combat vet,

cowboy, outdoorsman and most of all a proud father. He is great with the horses and has a lot of

experience and knowledge hunting, trapping and anything outdoors. The other client I was partnered

with tagged a 5x5 and Erik was there to do the heavy lifting. Erik also does taxidermy and has various

mounts at different businesses around the state. He is super easy to get along with and very helpful

with whatever you need. I'm signed up for the 2025 hunt and I can't wait to get back to camp for

another week of good times and making memories..
